PEMBERTON, NJ — Sen. John McCain ripped the Supreme Court’s decision on Guantanamo Bay detainees Friday, calling the ruling “one of the worst decisions in history.”
“I think that it is it opens up a whole new chapter in interpretation of our constitution, that says that people who are not citizens of this country and are enemy combatants–some of them still ardently seeking to destroy the United States of America and all that we stand for and believe in–are now granted habeus corpus rights,” McCain said, refering to the 5-4 decision that found that foreign detainees have rights under the constitution to sue in civilian courts. “We will regret very much in the days and months and years ahead this decision by the United States Supreme Court.”
The presumptive GOP nominee, joined by Senators Joe Lieberman and Lindsey Graham at a press conference, said he plans to “exhaust” all legislative options to narrow the impact of the decision and will first take aim at “eliminating the frivolous suits, the complaints about diet or whatever, reading material, or whatever it is, and try to more narrowly define it.”
Sens. Lieberman and Graham also trashed the decision at the press conference.
McCain initially said he had “concerns” about the decision an hour after the ruling was released Thursday, but after a day to digest the ruling he took his language up a notch.
“Our first obligation is the safety and security of our nation and the men and women who defend it. This decision will harm our ability to do that,” McCain said at a town hall meeting prior to press conference, where he also took the opportunity to blast Obama’s judicial appointment philosophy.
“Senator Obama applauds this decision and he supports it…I strongly supported Justice Roberts and Justice Alito, Senator Obama opposed them and voted against them on ideological grounds, something which is precedent breaking from the past,” McCain said, noting that he had previously voted in Justices Ruth Bader Ginsburg and Stephen Breyer, who both supported the Court decision, even though he didn’t share their judicial philosophy.

I do solemnly swear (or affirm) that I will faithfully execute the Office of President of the United States, and will to the best of my Ability, preserve, protect and defend the Constitution of the United States.
Preserve, protect and defend the Constitution, that is your first obligation otherwise you are unfit to be president.
McCain stated in the same talk:
“We are now going to have the courts flooded with so-called, quote, Habeas Corpus suits against the government, whether it be about the diet, whether it be about the reading material.”
So now John McCain doesn’t believe in the basic legal principle of Habeas Corpus? And this it the guy Republicans want for president?

What does McCain think will happen when you want shut down a prison where prisoners are being held for killing our boys on the battle field. Where should we move these prisoners to John? US Prisons? Should we read them their miranda rights and give them their one phone call. I am glad he decided to step up his rhetoric once he had a day to see what the country was saying about it. Shows great leadership and conviction. This is supposed to be the tough guy on terrorist? Come on John

If they are “enemy combatants” as you say, then why is the Geneva Convention not being applied.
That’s why the Supreme Court had to intervene. ALL human beings have rights. As the greatest superpower with high moral ethics, the application of those ethics must be paramount. So far they are lacking. It is no wonder the rest of the world lacks respect for the United States.
Finally someone (the Supreme Court no less) is seeing reason.

Also, Mr. McCain seems not to understand the concept of habeus corpus, which literally means something like “present the body.” It is used to challenge indefinite detention, or the legality of ones detention, and not ones reading material or diet. But, alas, these are details that Mr. McCain needn’t trifle with. It is surely easier to equate habeus corpus to frivolous lawsuits, thereby accomplishing a two-birds, one stone attack on the terrorist coddlers and trial lawyers. Well done John, truth be damned!
“one of the worst decisions of all time.” Interesting. When I think of the worst decisions of all time i tend to go with Dred Scott, Plessy v. Ferguson, and Korematsu. All three decisions strip an individual of their rights due to their membership in a certain class of society. For some reason this decision strikes me as the opposite, dictating that certain fundamental rights are due to all. Seems like I’ve heard that somewhere else as well….

Well said Mccain, the ruling was absurd. I feel for those whose have lost love ones to these animals. They don’t wear a combat unform have no regard for human life are well treated when captured and now these liberal judges give them constitutional rights. There are SO MANY people being detained illegally in our jails - most on falsified ‘child support non payment’ allegations that aren’t even investigated or true. The Doors to the Courthouses have been blocked for ‘ordinary citizens’ for a LONG time…
If it weren’t for Habeas Corpus - the courts and their lawyers could do anything they wanted without being held accountable - hell, it’s already that way what am I talking about?
Gitmo prisioners should face a panel of Judges representing all the Nations terrorized by their particular extremist hate group. Other countries of the World might not be so concerned about their civil rights.

McCain should study Article III Section 2 of the Constitution before making any more confused and foolish statements. His speech reflects either his total ignorance of the basis on which the United States was founded or his complete lack of respect for it.
The Court got it wrong yesterday. The Constitution of the United States of America is to protect the citizens of the United States. It does not make sense to allow detainees, who are not U.S. Citizen, and who do not believe in a democratic society to use the Constitution to their advantage when they need it, while they put down our democratic society. Justice Scalia is one of the most principled Justices on the Court, and he gets it right most of the time.
Since Hillary is no longer in it, I switched to John McCain. Know what, for the very first time I am really proud of my country.
Mr. McCain seems to have lost his mind and his memory. Wasn’t he subjectded to torture and mandatory detention, with no review from the Vietnamese military. And wouldn’t he had benefited himself from a ruling of this type if he was still hypothetically being held prisoner.
Moreover, I agree with the post below that he is unfit to be president as he favors trashing the constitution - which he would swear to uphold if he became president.
The thing is I do not believe that a man or woman who has no respect for our country has the right to claim the basic rights they do not respect. And I do not think people who want to kill and destroy it have any rights. I for one am all for trials and exicutions of every terrorist in prison if they are found guilty. As for their rights, give them the same ones they give others, oh yeah that is none if you do not believe as they do, so boohoo for them.

The 2000 version of John McCain would have lauded this decision, which clearly states that the president - any president - is not above the law.
The 2008 model, however, feels he must throw red meat to that frothing wing of the Republican party that divides the nation into “conservatives” and “traitors.”
Everything that made McCain so appealing years ago, the thoughtfulness and independence, has been sacrificed at the altar of electoral ambition. We were never able to lump McCain in with the reactionary crowd - the “agents of intolerance” - of Limbaugh, Rove, Cheney, Coulter, et al. Now we can. How depressing.
Courage and conviction? No way. Pandering of the most blatant sort? Yep.

This recent Supreme Court decision does not protect and defend the citizens of the United States. The interest of the terrorists are put above the interests and safety of America. We will all pay for this. These terrorists could hire ACLU lawyers at the taxpayers expense, and then go to the most liberal judges who will eventually let them get back to where they came from and terrorize. It will jeopardize and put our fighting men and women at risks.

John McCain has ben saying he wanted to close GITMO and he is right. Our international standing is severely degraded as a result. Moving them to Levenworth, etc is a more “institutional” method for legitimizing the confinement. For those that do not feel we need international image, I would remond you that everything we are trying to do in Iran, Syria, South Korea, etc DEPENDS strongly on this image…..JMAC got it right.

The subversive court has no judicial jurisdiction in such cases. The military tribunal should have tried them and those who were guilty should have been executed saving the taxpayers millions!

Now even the Supreme Court doesn’t understand the nature of war prisoners. If they can’t figure out what a war is, just like the liberals, then we most certainly will lose the war, and we most certainly will be attacked again, this time much worse than the World Trade Center.

I am confused about Sen McCain’s comments on the recent Supreme Court decision on prisoners at Gitmo. He wanted to close Gitmo…and that’s public record. Now he thinks the Supreme Court Decision was a terrible mistake. How do you reconcile these two views? As a long time viewer of Fox I hope that Fox will continue its reputation for fair and balanced reporting. I am looking for balance in the John MCain of 2000 an the John McCain who desperatley needs to find his base in 2008.
Would Fox be interested in discussing how establishing Guatenamo has actually contributed to the terroist threat. If you throw people in jail without just cause and tell them for years on end that they are terroists they may start believing it and maybe not thinking well of US because of how they have been treated.
Who would even want those who are innocent after years of confinement? A sad legacy for our country if you are open to looking at it from an unbiased viewpoint.

McCain considers this Supreme Court ruling on Gitmo the “worst decision in history,” except for the fact that it isn’t what the Bush administration wanted. He also in 2003 said ,

If someone held you at gun point and threatened your very existence. Then another fellow American such as a concerned citizen or a police officer helped you escape from this deadly situation and apprehended this criminal, how would you feel if the criminal sued the Governement , the concerned citizen or the police officer for 1 million dollars and the Supreme Court granted it, how would you feel?
Last Friday at a local vacation bible school my six year old son was kicked in the groin and called stupid by two of his peers because he likes Thomas the Tank Engine. My wife and I told him to just walk away if this happens again but I really wanted to tell him to drill the other kid in the face.
My fear is that worse things would happen to him if he retaliates. We’ve reached a point of no return in our society where we can no longer defend ourselves. It is days like these that make me think our situation might be un-fixable. I spent six years of my life fighting for this? If you screw up at work it is documented, filed and noted for future use against future behavior. If you screw up in the world you are rewarded money? Come on people.

The Supreme Court followed the intent of our forefathers perfectly in this decision. After all we do believe that “all men are created equal, that they are ENDOWED BY THEIR CREATOR with certain unalienable Rights, that among these are Life, Liberty and the pursuit of Happiness.” right?
According to the words in the Declaration of Independence above these rights are not obtained by reason of U.S citizenship, rather they are obtained by reason of being human. Therefore, government cannot deprive ANY person of these “natural rights” unless he or she is found guilty by a jury of his or her peers.
Could you guarantee that in declaring the hundreds of people that our government has to be “enemy combatants” that they have not now, nor ever will make a mistake? (Yeah right). If that cannot be guaranteed then there HAS to be a way for the imprisoned to challenge their classification in court and that is exactly what the Supreme Court said.
There was no other decision the Supreme Court could have made without denying that our rights are natural and not derived from our government (a concept that ranks very high among conservatives and constitutionalists.)
John McCain is right about the Gitmo decision extending our rights to foreign combatants captured in war. There is nothing NOTHING in the Constitution that extends any rights to people who are not American citizens. This is the worse decision in the history of America. This out of control court has made a LAW they just pulled out of a hat. We have the right, when a branch of government oversteps it’s authority, to shut it down. It has been done before and should be done this time. The Supreme Court has no mechanism to enforce anything by itself. Congress should come to it’s senses and refuse to obey it.

Why does our Constitution apply to Terrorist. They should be tried by a military court. If i were President Bush i would ignore the courts decision, since he only has a short time in office left and get trials moving asap,before they have a chance to be heard in Federal Court.

The Supreme Court really had no choice but to reach this decision because of foot dragging by the Bush Adminstration. It is sad to see some of these prisoners gain access to the federal court system instead keeping their cases in military courts where they belong. The accords defined by the Geneva Convention were not being met, so the Supreme Court was forced to allow them access to federal courts, OR ORDER THE IMMEDIATE RELEASE OF ALL.
But, as pointed in articles out elsewhere, the Administration has been holding prisoners without charges, hearings, attorneys or trials. The argument that these are “enemy combatants” is empty because it is a term invented to justify the treatment. I blame this unfortunate decision on blunders by the Bush Administration to process these prisoners in a timely fashion.
