One of her two guest commentators, a Democratic Party operative, went on at length about protecting against “swift-boating.” This reflects an attempt by the mainstream media to create the myth that the Swift Boat entry in the 2004 election was untrue and unfair. Quite the contrary, the Swift Boaters told the truth and gave the lie to Kerry’s ridiculous attempt to picture himself as a war hero — they were dedicated officers who had served with him and knew his record which was anything but heroic; to them, his claims insulted every serviceman who served honorably in Vietnam. They knew that he sought out minimal risk, faked injuries, and attempted to recommend himself for Purple Heart medals (unheard of in military annals) and got himself out of a combat situation as quickly as possible. I think this is a great idea…. one that should be done from the beginning of any election process for all candidates. Ideally this would be done by an unbiased 3rd party, however. I went to the site and unfortunately there is no place to enter questions of rumors I would like to see validated or squashed… for example, is it true that Obama’s father is Muslim? Is it true that Obame is half white? If so, why is he continually referred to as a ‘black’ candidate? I am more excited about a mixed racial president than I am about one who affiliates him or her self with a single racial background. Maybe Barack has commented on that, and I just haven’t heard it.

I don’t know who the PARENT COMPANy is, but I know that if they are fabricating this tape and need more time or are outright lying about it, it will backfire right back on Sen. People keep saying that Sen. Obama can not get the WHITE VOTE. The way I see it Sen. McCain will not get very much or the BLACK, BI RACIAL, or HISPANIC vote if this keeps up. I am WHITE over 50 and make less than $40,000 a year and I know when something SMELLs BAD. and issues.
Attacking a candidates wife is LUDICRIS. It is disgusting and LOW CLASS. I could go on, but it will probably not stop who ever has a plan to discresit the candidate.

On Saturday, 31 May 2008, DNC RBC Committee Member Ralph Dawson moved the following motion (this is a verbatim transcript of the motion as recorded on CSPAN).

“I (Dawson) move as follows:

1. that all pledged delegate positions from Florida be restored provided that each pledged delegate shall be entitled to cast one-half vote;
2. all pledged delegate positions shall be allocated taken into consideration the results of the January 29, 2008, contest as follows, the total shall be :
a. Senator Clinton, 52.5 delegate votes;
b. Senator Edwards, 6.5 delegate votes;
c. Senator Obama, 33.5 delegate votes;
3. all unpledged delegates shall be allocated by the Call and shall be entitled to cast one-half vote each at the Convention;
4. we further instruct the state party to conduct a process to fill the pledged delegate positions in accordance with Rules 5, 6, 7 and 12, including specifically, the candidate’s right of approval.”

This motion was approved by a vote of 27-0 with Allan Katz abstaining as required by the rules (a person from the state involved in the appeal cannot vote on that appeal).

Here is what Rules 5, 6, 7 and 12 address:

· Rule 5: Non-discrimination;
· Rule 6: Affirmative Action;
· Rule 7: Inclusion Programs; and,
· Rule 12: Presidential Preference.

Yesterday afternoon around 3 PM the DNC Staff released a memo that reads “It is our understanding that the Obama for President Campaign wants to re-select delegates only at the pledge PLEO and at-large levels.” Please see attached Adobe file for the memo.

I am going to leave aside for the moment that there are no rules in the Charter, the Delegate Selection Rules, the Call of the Convention or the Rules of the DNC RBC that allow the removal of delegates AFTER they were selected. In fact, the Dawson motion itself does not allow the removal of delegates AFTER they were selected (re-read it and see if it does).

I am puzzled by two things here. First, the DNC staff use the language “It is our understanding” that the Obama campaign “wants” to purge “delegates only”.

“Understanding” is an interesting choice of words. Either the Obama campaign said purge them or they did not. Also, since this understanding applies to PLEO and At-Large “delegates only” I assume that the Congressional Districts delegates and ALL alternates (including the two chosen at the At-Large level) are not purged.

The second thing I am puzzled by is why the DNC staff took 268 hours to write this memorandum and then gives delegate candidates 26 hours to qualify.

Giving 26 hours to qualify hardly fulfills Rule 7 which actually addresses timely outreach to our different constituencies. Rule 6, which requires Affirmative Action outreach, is unlikely to be fulfilled within 26 hours (everyone does not have a computer; everyone is not sitting at their computer 24/7 waiting for email).

You Cannot Remove Delegates

Even if Senator Barack Obama said to purge the delegates there are no rules that allow him to do so. Senator Obama, like you and me, have to follow the rules.

Rule 12 gives Presidential campaigns the right to approve or disapprove delegate candidates who run to be a delegate to the 2008 Democratic National Convention.

On 24 March 2008 the Obama campaign was given a list of delegate candidates for the position of PLEO delegates. They had until 28 March 2008 to disapprove any of the candidates. Not responding constitutes approval. After this four day period went by no delegate candidates were struck by the Obama campaign.

On 5 May 2008 the Obama campaign was given a list of delegate candidates for the position of At-Large delegates. They had until 9 May to disapprove any of the candidates. The Obama campaign did not disapprove any candidates.

In fact, Rule 12 only addresses approval or disapproval of a DELEGATE CANDIDATE. The opportunity to approve or disapprove candidates has passed.

There is no provision in the DNC Charter or in any rule which allows the removal of a delegate by a Presidential campaign once that person is selected and elected as a delegate.

The only provision on replacing a delegate in the rules is if they resign or die. This is not the case.

There is more I could say but this note makes the point. I would write a five page memorandum citing specific rules which indicate the DNC staff memorandum is not based on any rules of the DNC. This would include who votes on vacancies in a delegation.

PS Many want to roll over and allow this to happen. When the rights of others are abused by those in authority then my rights are diminished. My friend Allan Katz is abusing the rights of others (the rightful delegates properly chosen) and by so doing is diminishing us all.
